Subject: A Contract for teenage drivers

This is kind of long, so I'll post it in several parts. . . Also it is supposed to be in outline form with the A's and B's and 1,2,3's indented, but I couldn't get it to go that way.


A Contract
Entered into this ______day of _____, 200____ between __________(Teenager's name) and ______ (The Parents) regarding _______'s use of _________automobile (The Car).

Preamble:
When in the course of human events it becomes necessary for one teenager to drive the car of his parents, a decent respect to the opinions of mankind requires that they should declare the conditions that govern such an undertaking.

I. The Car belongs to The Parents. Always did, and always will. Even though we may casually refer to it as "Joe's car," it nonetheless remains the personal property of The Parents.
A. The Parents may at any time choose to drive The Car for their own personal use.
B. After each use, The Car must be returned to The Parents in a condition substantially identical to the condition in which it was borrowed, which includes but is not limited to
1. External cleanliness
2. Internal cleanliness
3. Condition of paint, body, glass and trim.
C. The Car may not be modified in any way without the express permission of The Parents.
D. In the event The Car is modified, at the end of the usage period,
1. If the modification can be removed, it may be removed at Joe's discretion, but The Car must be returned to a substantially identical condition to the one in which it was received.
2. If the modifications can not be removed, the modifications become the property of The Parents.
E. The Parents, as owners of The Car, will be financially responsible for:
1. Scheduled maintenance, including but not limited to oil changes, batteries, tires, and brake maintenance.
2. All necessary towing and mechanical repairs incurred in the normal, Parent-approved operation of The Car.
F. Joe will be financially responsible for all repairs necessitated by off-road use, aerial use, underwater use, overwater use, and all other unapproved usages including use which leads to an accident.

II. Driving is a Privilege, not a Right
A. This privilege is extended on the basis of trust, and may be withdrawn at any time for any reason.
B. Trust is earned by
1. Doing what we say you'll do
2. Doing what you say you'll do
3. Demonstrating maturity
4. Not screwing up.
C. Trust is destroyed by
1. Disobeying The Parents
2. Not telling us the truth
3. Behaving in an immature manner
4. Using The Car in the commission of "getting in trouble."
D. No Trust, no driving
E. Suspension of driving privileges may be used as a consequence of misbehavior unrelated to driving activities.
F. As _____ ages, matures, and demonstrates an increasingly mature attitude by his good driving habits and consistent obedience to the terms of this contract, his driving privileges may be expanded over the next few years.
III. ______ will be a responsible driver. _____ agrees to operate The Car
A. according to the applicable sections of the Idaho Code
B. with politeness and courtesy to other drivers.
C. With an eye to safety foremost
1. Seatbelts will be worn by every occupant at all times.
2. The speed limit will be observed.
3. Eating while driving will not be allowed until further Parental notice.
4. Cell phone conversation while driving will not be allowed.
5. ________ will remain a safe distance away from all mailboxes.
D. ______ agrees to not carry passengers unless approved in advance by The Parents.
E. ________ agrees not to drive down 17th street with his subwoofers loud enough to be audible or otherwise detectable more than one car away.

IV. _____ is financially responsible for his driving.
A. _____ pays for all consumables, including but not limited to
1. Gas
2. Transmissions are not a consumable.

B. Insurance
1. It will cost The Parents $XX.XX each and every month in increased insurance premiums for _____ to drive. We will pay that out of the goodness of our hearts.
2. In the unfortunate event that _________ does anything that results in an increase in that premium and _____ is still allowed to drive, _____ will be required to pay the additional premium each month if his driving privileges are to continue.
a. Things that are likely to lead to a rate increase include
(1) Bad grades
(2) Accidents or other claims on the insurance
(3) Tickets

C. The Parents may from time to time require _____ to use The Car to run errands for The Parents, but will not be required to put gas in The Car. _____ agrees to this as partial payment for the privilege of using The Car. The Parents may choose to put gas in The Car at any time, but are not obligated to do so.

D. _____ agrees to occasionally run errands for the benefit of The Parents without complaining vocally as partial payment for the privilege of using The Car. Scowling, grimacing, and other contorted facial expressions of displeasure are allowed as long as they do not result in permanent facial deformity.

V. Obtaining permission to drive The Car.
A. _____ must file a flight plan either orally or in writing before driving the car.
B. The flight plan is to include departure time, passenger list, all destinations, and return time.


Know all men by these presents that we, the undersigned, do herewith enter into this binding contract of our own free will and without compulsion, coercion, or other constraint. O.A.C., void where prohibited. Past performance does not guarantee future results. E pluribus unum. Professional driver on closed course, do not try this at home. Don't cry over spilled milk. God save the Queen.

I glanced through it and didn't notice anything about what we do... We require that the teen has enough money in an account to cover the deductible in case of an accident. :)

Just for the record, I'm not saying the way we did things is the best way for everybody. It's just what worked for us. I totally get it that paying for their own car can be a good idea for a lot of kids. We just happened to have just bought a van so we had my old car sitting around and I was 8 months pregnant with child #5 and DS was in sports so he couldn't ride the bus home so it was a tremendous help to me for him to drive right away rather than waiting for him to earn the money for a car. Plus he was very responsible and I trusted him. Also, we ended up modifying things. We decided pretty quickly that he could give other kids rides at lunch or home from practice without checking in every time. But, easier to add privileges than wish you'd been stricter in the beginning. Also, contrary to what it says in the contract, I ended up paying for most of his gas. He was putting almost all of his money in savings for college/mission and I decided I'd rather help with gas and have him save for college/mission. Hope this is helpful.

*Disclaimer. I must humbly admit that I did not do a good job at following through about the car being clean when returned. About a month after he left for his mission, I went to put something in the trunk and was greeted with an entire summer worth of empty and half-empty water bottles and muddy clothes from moving sprinkler pipe. Oh well.

My contract...was different
For my son....you will be allowed to drive when you becone an Eagle scout.
He didn't get his learners permit before his 18th birthday...cause he never got his Eagle.
For the girls...it was...learn to control your mouths before you will learn to control my car....for 2 daughters they also waited until 18 before getting their licenses....and I may be becoming a softy....but my 17 year old has a learners permit.
